Terms and conditions of use

Preamble

These Terms of Use (ToU) define the conditions of access to and use of the SDVFR application, published by the company SKYDREAMSOFT, hereinafter referred to as "the Publisher".

Any person accessing the application, for any reason whatsoever, is considered a user (hereinafter "the User") and acknowledges having accepted, without reservation, these ToU in their latest applicable version.

2. Purpose of the application

SDVFR is a mobile application (available on smartphones and tablets) designed to assist with air navigation, providing cartographic and aeronautical data for trained pilots holding the necessary flight qualifications.

3. Acceptance of the ToU

Using the application implies full and unconditional acceptance of these ToU. They may be modified at any time by the Publisher; the User is invited to consult them regularly.

4. Service access and user obligations

The SDVFR application runs on recent versions of Android and iOS systems. Some third-party components or services we use no longer support outdated versions, requiring us to follow their pace to ensure stability, security, and performance.

An internet connection is required to download data, access certain features, or perform updates.

SDVFR uses the tablet's internal GPS module. This module is necessary to track the user's aircraft on the map. However, the Publisher is not responsible for any temporary degradation of signal quality due to weather conditions or GPS receiver issues.

Access may be temporarily suspended for maintenance or updates. SDVFR features may be temporarily or permanently disabled without notice, depending on the availability of the data sources used by the Publisher.

The user agrees to comply with these terms of use.

The user agrees to use SDVFR for private purposes only and not for commercial use.

5. User account

Access to the application requires the creation of a personal account on the website https://skydreamsoft.fr and a login using those credentials in the SDVFR app.

The User agrees to provide accurate information, keep it up to date, and maintain the confidentiality of their credentials.

6. Intellectual property

The application, its content, data, maps, logo, and brand are the exclusive property of SKYDREAMSOFT. Any reproduction, distribution, or modification without written authorization is prohibited.

7. Responsible use of the application

The application is a tool for flight preparation and navigation. The User remains solely responsible for the flight, compliance with air rules, flight safety, and lawful use of the application.

According to European SERA regulations, it is the pilot’s responsibility to ensure, before each flight, that they are aware of all relevant aeronautical information, including airspace, weather conditions, and restrictions (NOTAM, SUP AIP, etc.).

The User must maintain constant vigilance of the external environment during flight. Excessive focus on the screen may lead to situational unawareness and represents a significant accident risk. The SDVFR app must never distract the User from their primary responsibility: ensuring flight safety, monitoring surrounding airspace, following air rules, and maintaining visual awareness ("see and avoid" rule).

SKYDREAMSOFT cannot be held liable in the event of an accident, incident, or regulatory violation.

8. Fair use of the application

The User agrees to use SDVFR reasonably, fairly, and according to its intended purpose: assisting in flight preparation and navigation for personal use or within a previously authorized professional framework.

Without express prior authorization from SKYDREAMSOFT, it is strictly prohibited to:

  • attempt to misuse the application’s features for unintended purposes;
  • use the app for commercial demonstrations, presentations at trade shows, or promotional use for third parties, particularly in the aeronautical or technological fields—except for pedagogical or training use within an aeroclub, flight school, or similar institution, provided this does not amount to resale or integration into a commercial offering;
  • reproduce or publicly distribute any part of the application (screens, videos, screenshots, maps, etc.) for commercial purposes;
  • use the application in an automated way (scripts, bots, etc.) for data scraping, server overload, or other unintended purposes.

SKYDREAMSOFT reserves the right to restrict, suspend, or revoke access to the app for any user or organization found to have misused it, and to take legal action if its rights or product integrity are compromised.

9. AIRAC cycle and updates

The SDVFR application is updated regularly, including:

  • updates of aeronautical data according to the AIRAC cycle (every 28 days),
  • bug fixes,
  • functional improvements,
  • and regulatory or technical adaptations.

The User is encouraged to install updates promptly, outside of flight or navigation phases, to benefit from the latest data, optimal functionality, and enhanced safety.

Visual alerts are displayed in the app to notify the User of outdated data. However, AIRAC updates may occasionally be delayed by a few hours or days for technical or editorial reasons, independently of the theoretical date shown in the settings.

Therefore, the User must always verify data freshness before each flight, in addition to standard regulatory preparation procedures.

If updates are not installed, some features may become unavailable, unstable, or unsuitable, and SKYDREAMSOFT cannot be held liable.

10. Personal data

User personal data is processed in compliance with applicable laws, including Regulation (EU) 2016/679 (GDPR). For more details on the types of data collected, their purpose, retention period, and user rights (access, rectification, deletion, etc.), please refer to our Privacy Policy in the Terms of Sale (ToS).

Users may request the closure and deletion of their account at any time via the support address info@skydreamsoft.fr

11. Complaints and mediation

In the event of an unresolved dispute after contacting customer support, the consumer may use consumer mediation services free of charge.

12. Liability

The SDVFR application is a navigation aid tool intended for trained pilots with the required qualifications. It relies on official aeronautical data sources (AIP, NOTAM, SUP AIP, etc.) but does not replace regulatory flight preparation or direct consultation of these sources.

The Publisher cannot be held responsible for errors, omissions, or delays in the publication of such official data. However, SKYDREAMSOFT will, where possible, report any anomalies or inconsistencies identified in these sources to the relevant authorities.

The Publisher cannot be held liable for direct or indirect damages resulting from the use of the application, its unavailability, or misinterpretation of its data.

The SDVFR application is not free of malfunctions. The User remains solely responsible for their flight planning and monitoring. Any malfunction may be reported via the forum at https://forum.skydreamsoft.fr or by email at info@skydreamsoft.fr. The Publisher commits to providing support and follow-up, but without any guaranteed resolution timeframe or obligation to fix the issue.

13. Governing law and jurisdiction

These ToU are governed by French law. In case of dispute, the courts of Paris have jurisdiction, unless otherwise stipulated by law applicable to the consumer.
